This California Privacy Notice supplements the information contained in the Benefit Cosmetics Privacy Policy and applies to residents of the State of California (“you,” or “consumers”).

YOUR CALIFORNIA PRIVACY RIGHTS

The California Consumer Privacy Act (“CCPA”) provides some California residents with additional rights, including the right to: (i) request information about the categories and specific pieces of personal data we have collected about you, as well as the categories of sources from which such data is collected, the purpose for collecting such data, and the categories of third parties with whom we share such data; (ii) request information about our disclosure of your personal data to third parties for business purposes; and (iii) not be discriminated against for exercising any of these rights.

RIGHT TO KNOW

California residents have the right to know the categories of personal information we collect, as well as the categories of sources from which such data is collected, the purpose for collecting such data, and the categories of third parties with whom we share such data. The following chart contains this information, but please see our Privacy Policy for more detailed information. Note that we do not “sell” your personal information. We may share your personal information with Benefit Cosmetic Affiliate Companies, third-party service providers, and government entities as needed to comply with law or to prevent illegal activities. RIGHT TO ACCESS

California residents have the right to request the specific pieces of personal information we have collected about them, as well as information about our sale or disclosure for business purposes of their personal data to third parties. Once we receive and confirm your verifiable consumer request, we will disclose to you the specific pieces of personal information we have collected about you.

RIGHT TO DELETE

California residents have the right to request that we delete any of your personal information that we collected from you and retained. Please note that this is a limited right as there may be a legal or other lawful obligation to preserve certain data. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

RIGHT TO NON-DISCRIMINATION

California residents have the right to not be discriminated against for exercising your rights under the California Consumer Privacy Act.

CA SHINE THE LIGHT DISCLOSURE

If you are a California resident, California Civil Code Section 1798.83 permits you to make an annual request for information regarding the disclosure of categories of your personal data that Benefit Cosmetics has shared with a third party for the third party’s direct marketing purposes. To make this request, please submit a request through the Benefit Cosmetics Privacy Portal.

CA DO NOT TRACK DISCLOSURE

Do Not Track is a privacy preference that can be set in a web browser. This website does not recognize Do Not Track browser settings or signals at this time because there is not agreed upon standard for how to interpret these signals yet. EXERCISE YOUR CALIFORNIA PRIVACY RIGHTS

To exercise your rights under CCPA, the easiest way to submit a request is through the Benefit Cosmetics Privacy Portal here. You may also call 1-800-781-2336 to request assistance with submitting a request. Benefit Cosmetics will endeavor to respond to your request with 45 days of receiving that request.

If we require more time, we will inform you of the reason and extension period in writing. Please note that additional information may be requested from you to confirm your identity. This is to ensure that your personal information is not disclosed to a person who does not have a right to receive it. We will only use personal information you provide in connection with your request to review and comply with your request. Depending on your request, we will ask for information such as your name, the last item you purchased from us, or the date of your last purchase from us. We may also ask you to provide a signed declaration confirming your identity.

AUTHORIZED AGENTS

In some circumstances, you may designate an authorized agent to submit requests to exercise certain privacy rights on your behalf. We will require verification that you provided the authorized agent permission to make a request on your behalf. You must provide us with a copy of the signed permission you have given to the authorized agent to submit the request on your behalf and verify your own identity directly with us.

If you are an authorized agent submitting a request on behalf of an individual, you must attach a copy of the following information to the request:

1. A completed Authorized Agent Designation Form indicating that you have authorization to act on the consumer’s behalf.
2. If you are a business, proof that you are registered with the Secretary of State to conduct business in California.

If we do not receive both pieces of information, the request will be denied.

ADDITIONAL INFORMATION

From time to time it may become necessary to update or change this California Privacy Notice. When we do, we will also revise the “Last Updated” date at the top of the California Privacy Notice.
